Terms of Sale

PAYMENT

VISA, MasterCard, and Discover credit and debit cards are accepted. Orders can be submitted online or by phone. Credit card orders can be shipped only to an address that the card issuer has on file for the cardholder. No foreign orders or cards issued by a foreign bank. A valid customer daytime telephone voice contact number must be supplied as well as the name of the issuing bank. Orders will not be processed due to any of the following reasons: invalid card number, expiration date or security code; valid customer telephone voice contact number not provided; the transaction is not approved by the card issuer for any reason; or if we are unable to verify the account information or obtain address verification from the card issuer. Stringent anti-fraud measures are applied to all transactions.

SHIPPING

There is a flat $9.95 shipping/handling fee for all orders, no matter how large or how small the order is.

Most orders ship within 1 business day of receipt.

The customer is responsible for providing a correct and complete delivery address, including apartment/suite number, correct zip code, etc., and for accepting the parcel at that address. The customer agrees to reimburse the seller for any address correction fee and/or return shipping costs incurred.

Orders are shipped via US Postal Service or United Parcel Service (UPS) at our option. UPS Air deliveries are available at additional cost.

Delivery method and carrier is at the discretion of Shomer-Tec.

FOREIGN ORDERS

No foreign retail orders are accepted. However, we can refer you to Shomer-Tec dealers who will accept foreign orders.

RETURNS

Items may be returned for a full refund of the merchandise price only if returned in original, readily-resalable condition within one week of receipt, except as noted below. No return authorization is required, just make certain that the conditions specified in this section are met before returning any item. Returned items must be postmarked within one week of the date of delivery. The invoice (or photocopy) must be included. All literature and product packaging originally supplied must be included in original unmarked condition. Do not use a product box as an outer shipping container. Special-order and hygenic items are not returnable. If a return is necessitated due to a clear error on our part, reasonable ground shipping costs can be reimbursed. Address for returns via Postal Service: Box 28070, Bellingham, WA 98228. Address for returns via UPS or other non-postal carrier: 3861 Mustang Way, Bellingham, WA 98226 (do not use this address for US Postal Service – it will not be delivered). Since the shipper is responsible for loss or damage in transit, we recommend that you ship via a trackable insured method.

LEGAL STATUS OF PRODUCTS

It is the responsibility of the Buyer to ascertain and comply with all applicable local, state, and federal laws and regulations regarding possession and use of any item in this catalog. By placing an order, the Buyer represents that he/she is of legal age and that the products will be used only in a legal and lawful manner.

MISCELLANEOUS

All orders shipped to an address in the state of Washington will be charged state sales tax (except federal government orders). The sales tax rate is dependent upon the destination, and varies according to the city, county, transit district, etc. Tax applicability subject to change.

All patches are sold strictly for collecting purposes. Any other non-authorized use may be illegal. By placing an order for patches the Buyer certifies that he/she is a bona fide collector and that the items ordered will be used solely for legal collecting purposes.

Product specifications are subject to manufacturer's changes.

Every effort is made to ensure accuracy; however, we are not responsible for typographical errors.

In the event of a dispute between the Buyer and Shomer-Tec which cannot be resolved by negotiation, and in the event the Buyer undertakes to sue the Seller in a court of law, then it is hereby stipulated that venue for any such actions shall be only in Whatcom County, State of Washington.

All orders are subject to acceptance by Shomer-Tec, Inc. in Bellingham, Washington, who reserves the right to refuse any order.

By placing an order, the Buyer signifies agreement to these Terms of Sale.

DEALER PROGRAM

A Dealer program is available for bona fide re-sellers. Please submit a email and supply your state resale tax number. We accept stocking dealers only – those who maintain an inventory of our products and actively market them. Minimum order quantities apply; goods are for resale only. No drop shipments. We do not use vulnerability scanning and/or scanning to PCI standards.

We do not specifically market to children under the age of 13 years old.
